McKean County Court Senior Judge William Morgan has issued his opinion on a ruling he made April 29 denying a motion by the defense to throw out search warrants in the homicide by motor vehicle while DUI case against Paul Morrisroe of Marshburg. Morgan ruled that police officers were within their rights to follow groove marks in the road from the accident scene in Cyclone to Morrisroe’s garage in Marshburg. He also commented that the garage, housing the pickup truck, wasn’t near Morrisroe’s house and there were no fences or markings indicating private property. And, he says the defense’s contention that the DUI arrest was illegal is false, because the arresting trooper determined that Morrisroe showed signs of intoxication. Meanwhile, Judge John Pavlock is still deciding whether the trial will be moved to another county or a visiting jury will be brought to McKean County to work the trial. Morrisroe, who remains free on $250,000 bail, is charged in the fatal hit and run accident which took the life of 20 year-old Dakota Heinaman of Cyclone last June.
