State Senator Cris Dush has introduced a bill to make local government officials immune from financial loss when they violate the law.
Under current Pennsylvania Law, dating back to 1933, the State Board of Auditors can surcharge elected or appointed officials for financial losses incurred by a township because of that official’s “act or omission in violation of law or beyond the scope of the officer’s authority.”
Dush’s bill would prevent auditors from seeking recompense from officials if those officials claim to be acting on advice of a Township Solicitor.
The bill has been sent to committee.
