More than two years into a criminal case for an alleged cryptocurrency investment scheme, Shane Hvizdzak has filed a motion to suppress statements made to law enforcement.
The motion, filed March 7, alleged that when federal agents showed up to search Hvizdzaks’ parents home, they questioned Shane without giving him his Miranda rights. The motion claims that he did not know he had the right to remain silent or to have a lawyer present.
The case against Hvizdzak and his brother Sean, of St. Marys, was based on an investigation by the FBI and IRS. The Securities and Exchange Commission has filed a civil suit as well, all alleging that the pair operated a crypto hedge fund scheme that bilked investors out of approximately $31 million.
