Lawyers for Payton Gendron, the man who shot and killed ten Black people at a Buffalo Tops in 2022, are asking to dismiss the entire federal case against him.
In a court filing, lawyers explain this federal death penalty case is redundant, considering Gendron was already sentenced to life in prison in New York State under hate crime statutes.
Gendron pleaded guilty to state charges in November, 2022. He was sentenced to life without parole in February, 2023.
The federal trial for Gendron is expected to start in September of 2025.
