Ahead of his federal death penalty trial, attorneys for the gunman responsible for the mass shooting at the Buffalo Tops in 2022 asked the court Monday for a change of venue.
Payton Gendron killed 13 people in a racially motivated shooting and was sentenced to life without parole on state charges in February 2023.
His federal death penalty trial is expected to begin in September, however Gendron’s attorneys are arguing the trial should be moved from Buffalo to New York City due to potential jury bias.
A judge will now go over the motion and decide if this case will be moved.
