A federal judge has rejected the motion by defense to dismiss hate crime charges against the Tops mass shooter on the three-year anniversary of the attack.
Peyton Gendron killed 10 people and injured 3 in a racially motivated shooting and was sentenced to life without parole on state charges in February 2023.
Defense attorneys contend that the language used in the argument was “too vague” because it states that Gendron used a firearm against unnamed ‘Black people,’ claiming this term isn’t enough to identify a specific individual and also claiming that it was ‘unconstitutional’ since Gendron was already convicted of a hate crime in New York State.
Judge Vilardo denied the defense’s request.
