A federal judge denied a motion to dismiss some of the charges against the Buffalo Tops mass shooter on Thursday, including charges that carry the death penalty.
Payton Gendron’s defense had previously filed to dismiss specific hate crime and firearm charges, arguing that the offenses were “not predicate crimes of violence.”
Judge Lawrence Vilardo addressed each argument presented by Gendron’s team in a 17-page decision before ruling against all of them.
This case is expected to be back in court in September for oral arguments on the defense’s motions to suppress evidence.
