The District Attorney’s Office seeks the death penalty against Tyler Prescott.
Prescott is charged with the rape and murder of his 2-year-old son.
The document submitted by DA Stephanie Vettenburg-Shaffer advises the defendant that the Commonwealth is seeking a death sentence if he is convicted of Homicide by 1st degree Murder, the qualifications of which have 18 factors including a premeditated killing, a victim under 12-years-old, the killing happened during another felony, torture and the killing being performed under the influence of a controlled substance.
First-degree Murder is the only crime possible for a death sentence in Pennsylvania.
