A judge ruled today that the federal trial for Payton Gendron, the man responsible for the racially motivated mass shooting at the Jefferson Avenue Tops back in 2022, will stay in Buffalo.
Gendron’s attorneys filed motions to move his federal trial to either New York City or Rochester, arguing they wouldn’t be able to find an unbiased jury.
However, the judge agreed with the prosecution’s argument that moving the trial would make it more difficult for victims and witnesses to appear in court.
A jury is expected to be selected in August with the trial itself expected to begin in October at the earliest.
Gendron is already serving a life sentence, convicted on hate crime charges, in New York State.
