The federal judge hearing the financial fraud case against the Hvizdzak brothers plans to rule in September on whether Shane Hvizdzak’s confession to the FBI can be excluded as evidence against him.
Hvizdzak and his brother Sean stand accused of allegedly operating a cryptocurrency hedge fund scheme that bilked investors out of about $31 million.
According to Assistant US Attorney Christian Trabold, Hvizdzak’s subpoena, which had been sent to HDR Global Trading Limited, commanding they turn over documents relating to Hvizdzak, is part of a “fishing expedition” that is not permitted under federal criminal rules.
The prosecution and defense filed a joint motion with Judge W. Scott Hardy on June 6 to hold the matter in abeyance as they worked to resolve the matters.
The court order noted the judge would take it under advisement for a period of 30 days.
