The federal death penalty case against Tyler Prescott who is accused of raping and murdering his 2-year-old son last August, has stalled pending the appointment of a new judge.
President Judge John Pavlock recused himself on March 5 due to concerns that actions he previously took as a McKean County prosecutor “may have relevance in this action.”
Judge Michele Alfieri-Causer also recused herself in a March order, citing a conflict regarding the proceedings.
Prescott was supposed to have a last date of plea on March 20, however this plea date is on hold until a judge can be appointed.
