Cattaraugus County Sheriff Eric Butler is among the 15 sheriff’s departments in New York State that filed a federal lawsuit against Gov. Kathy Hochul and Attorney General Letitia James to stop the state from enforcing a new law that bans local law enforcement agencies from entering into agreements with U.S. Immigration and Customs Enforcement.
The new law took effect Tuesday and prohibited local law enforcement agencies from entering into 287(g) agreements with ICE.
The sheriffs are asking the court to declare the law unconstitutional, arguing that they have the authority to decide if their counties cooperate with federal agents because they are independently elected.
