A former McKean County Judge and public defender has had his law license suspended for four years after numerous complaints.
James P. Miller was the Magisterial District Judge for District 48-3-02 from June of 2004 through December of 2005. He also served as an assistant public defender while in private practice in Smethport.
The disciplinary report issued by the Pennsylvania Supreme Court revealed that Miller engaged in “serial neglect” of his cases between 2019 and 2021 including failing to communicate with a 15-year-old defendant for 13 months, meeting with a 17-year-old defendant only once over the course of a year, and not performing any work on behalf of a client for 14 months, except to request a case postponement.
The suspension takes effect December 20th.

This happens more often than you might realize. Most of the times judges hide behind the letter of the law. In my case, my lawyer had a brain tumor and the Judge Masson whom didn’t even preside over my trial decided that the “Sufficiency of the evidence” and the “Insufficiency of the evidence (only to be decided by the sitting trial judge) didn’t matter. The victims were allowed to claim items despite not having to prove that the items weren’t consumed in the fire or prove beyond a reasonable doubt that the items actually belonged to them. Then my impaired attorney never objected to a pair of military boots (which belonged to someone else and couldn’t be ruled out, without one identifying characteristic matching them to one of the eight scenes.) with dog tags inside them from another person and were never in my possession to falsely place me at the scene. These judges need to be accountable for their actions and not be be protected, because their conduct can ruin lives as I can attest !!!!
