A federal judge has ruled that allegedly incriminating statements from Shane Hvizdzak to the FBI can be used against him at trial.
Shane Hvizdzak, of Bradford, and his brother, Sean, of St. Marys, stand accused of allegedly operating a cryptocurrency hedge fund scheme and bilking investors out of approximately $31 million.
When the FBI searched the High Street home of the Hvizdzaks in June 2020, Shane Hvizdzak was cooperative, talking to agents and even giving a written statement, allegedly outlining what had taken place. However, after hiring counsel, he filed to have the statements suppressed, saying he wasn’t read his rights and was in custody at the time of his interview.
