District Attorney Stephanie Vettenberg-Shafer is seeking the death penalty against the Port Allegany man accused of the murder of K-Leigh Hill-Nelson back in February.
28-year-old Brian Kuchinka is charged with homicide as well as three counts of aggravated assault and various other charges.
The district attorney has filed two motions to seek additional time in which to file notice of aggravating circumstances in the case.
A notice of this nature is necessary to let the defendant, and the court know that the prosecution believes they can prove beyond a reasonable doubt that at least one of 18 specific circumstances exists to qualify the homicide for the death penalty.
