The New York State Appellate Court issued rulings Friday in two civil cases linked to the 2023 Buffalo Tops mass shooting.
In one case’s decision, the court concluded that social media companies cannot be held liable for radicalizing Payton Gendron with the decision, voted 3-2, overturning a previous ruling by the State Supreme Court.
In the other case, the court did rule that legal action against the gun accessory manufacturer, Mean LLC, may advance.
This case, headed by Kristen Elmore-Garcia, claims that the company deliberately marketed its products as a way to get around New York State’s assault rifle ban and also claims that they give instructions on how to remove safety devices.
