A hearing was held for Gary Maull who wants his second-degree murder conviction vacated.
The Olean man was convicted of murder after the August 2014 shooting death of Otis Lamont Parks, however Maull believes his conviction should be set aside and a new trial ordered after police allegedly overheard his conversations with one of his lawyers.
District Attorney Lori Rieman, who testified at the hearing last week, said she welcomed the hearing as a way to correct the record. She said she had not received notice of the ruling and was “taken aback.”
Maull’s attorney, Lyle Hhadu, will be submitting supplemental statements before the judge issues a ruling on the factfinding hearing.
