The U.S. Attorney’s office has filed a motion with the federal court, seeking to quash subpoenas sought by Shane Hvizdzak in the federal criminal case against him.
Hvizdzak and his brother Sean stand accused of allegedly operating a cryptocurrency hedge fund scheme that bilked investors out of approximately $31 million.
According to Assistant US Attorney Christian Trabold, Hvizdzak’s subpoena, which had been sent to HDR Global Trading Limited, commanding they turn over documents relating to Hvizdzak, is part of a “fishing expedition” that is not permitted under federal criminal rules. The prosecution and defense filed a joint motion with Judge W. Scott Hardy on June 6 to hold the matter in abeyance as they worked to resolve the matters.
The judge approved the motion, and noted that the motion to quash the subpoenas would not be ruled on until after July 6, when the parties are to turn over a report on the status of the matter to the court.
