Attorneys in Shane Hvizdzak’s federal cryptocurrency fraud case agreed on several disputed sentencing issues.
In a joint filing last Wednesday, prosecutors and defense attorneys said Hvizdzak will not contest a sentencing enhancement for causing substantial financial hardship to over five victims and also agreed he wouldn’t qualify for a sentencing reduction.
U.S. District Judge W. Scott Hardy ordered the parties on Monday to continue discussing restitution and submit a joint status report by Nov. 19.
Shane and his brother Sean pleaded guilty in 2025 to federal charges stemming from a $31 million cryptocurrency fraud scheme.
Shane’s bond was previously revoked after probable cause was found that that he committed new wire fraud awaiting his sentencing.
