54-year-old Darvin Carpenter, a convicted child rapist, had his 160-year prison sentence upheld by the PA superior court and conditions for any type of release were struck down.
Carpenter was sentenced in McKean County Court in December of 2023 to over a century in state prison plus probation and determined to be a sexually violent predator, with lifetime requirements to register as such.
Carpenter filed an appeal challenging the legality of the sentence, maintaining that the probationary portion of the sentence was illegal and the sentencing judge had no authority to impose probation.
The state Supreme Court agreed on that motion, however they ruled that their decision did not impact the length of incarceration and upheld the sentence of 160 to 200 years.
